What is freehold & leasehold?
Freehold property is the ownership of the land on which the property is built.
Leasehold property is where the ownership of the land on which the property is built belongs to another person.
What is a ‘Chain’ in conveyancing?
This means that there is a sale or purchase by the seller or buyer of your property which will coincide with your transaction. There may be several connected sales and purchases which will be linked through the buyers and sellers. If your transaction is in a chain, then the transaction may slow down and will only move with the slowest link in the chain.
How long it will take to complete the purchase/sale?
We cannot give you an exact answer to this question until the contracts are exchanged. A normal conveyance without a chain takes between 4 to 8 weeks. Do not make any arrangements for your move until contracts have been exchanged and the completion date is fixed.
Can I pull out of my purchase/sale?
Yes, you can withdraw from the transaction at any time before the exchange of contracts. You cannot pull out of the transaction after exchange of contracts.
Is Deposit really necessary in a purchase?
Yes, but the deposit may vary from peppercorn to maximum 10% of purchase price according to circumstances.
When should we pay the Deposit in a purchase?
Your Solicitors needs the funds before exchange of contracts. Hence, you should make arrangements for cleared funds to be available to your solicitors before the exchange of contracts.
If I am selling, when will I receive the sale money?
This will be sent to you on the day of the completion or the next working day according to your instruction.
When do I pay the Legal fees?
In a purchase you will have to pay some money upfront (normally £250) on account of costs for searches.
Do I have to pay legal costs if the transaction fails?
Yes, we will charge according to the work done and you will also have to pay any disbursements incurred.
Do the Solicitors do surveys?
No.
Should I have a survey done?
Yes. It is strongly recommended that you arrange an independent survey of the property you want to buy.
Can I rely on the valuation report?
The lenders valuation report is not a survey, because the condition of the property is not considered in detail. Therefore, you cannot rely on a valuation report.
When and from where will I get the keys?
Normally the Estate Agents will be holding the keys and they will release the key on the day of completion after the seller’s Solicitor has received the entire sale price. This may happen any time before close of business that day. If there is no Estate Agent involved, contact the seller directly and make arrangement for the collection of keys on the day of completion.
What are Disbursements?
‘Disbursement’ is any expense (over and above our legal fees and VAT for acting for you and the lender) that we have to meet on your behalf in order to deal with your matter. All disbursements will be itemised in our statement of account. Thus disbursements are in fact goods or services, essential in your matter, supplied to you by other service providers. We will do our best to give you an estimate in advance, however, you will have to pay the actual cost of disbursements even if this differs from our estimate.
